Prosecutors had initially sought a 10-month prison sentence, but Magistrate Zia Faruqui did not believe that was necessary, instead ruling that Labrenz should not have profited from his “egregious conduct” and imposed a $100,000 fine.
Lavrenz is one of more than 1,400 people charged in connection with the 2021 protests.
Lavrenz has gained notoriety online for speaking out against the Justice Department’s handling of people charged in cases related to the Jan. 6 attacks.Number.
In addition to being sentenced to six months’ house arrest, Labrenz has also been asked to refrain from using the internet during his house arrest after prosecutors accused him of “profiting from the fame of a convicted celebrity” through his media appearances.
Former President Donald Trump defended Labrenz after his conviction in April, arguing that he was “unfairly targeted” by the Justice Department, and also shared a link to donate to his legal fund.
“This situation is not just about me, it’s about the people of the United States of America,” LaBrenz said.
Additionally, she reportedly claimed she was at the U.S. Capitol “to follow God” and said her actions were for a greater purpose.
Because Labrenz did not actively participate in violence or destruction of property during the protests, she was sentenced as one of the lesser offenders. But Judge Faruqui told her in court that it was still a felony.
“It is outrageous that the government is seeking to incarcerate this peaceful, nonviolent, elderly, retired, first-time offender in prison for months simply because Mr. Labrenz has openly informed the public about the criminal justice system against the January 6th defendants,” her attorney, John Pierce, wrote.
Prosecutors allege that Labrenz was inside the Capitol for about 10 minutes yelling, “This is our home, they can’t take it.”
Prosecutor Terence Park also argued during the trial that there was “no doubt” that LaBrennes wanted to undermine the legitimacy of Joe Biden’s 2020 victory.
“It seems she has committed to doing it again,” Parker said.
Labenz’s legal team reportedly plans to appeal the conviction and challenge the fine.
