A federal judge has rejected Hunter Biden’s latest attempt to dismiss tax evasion charges in a case expected to go to trial next month.

Trump’s lawyers sought to have the case dismissed in July, citing a recent ruling by a federal judge in Florida tossing out a classified documents lawsuit against Donald Trump, finding the appointment of special counsel Jack Smith unconstitutional.
Biden’s legal team, like Trump’s, also argued that special counsel Jack Weiss, who prosecuted the sitting president’s son, was unconstitutionally appointed.
In a seven-page ruling handed down Monday, U.S. District Judge Mark Scarci of the U.S. District Court for the Central California District Court did not address the merits of Biden’s arguments, but dismissed them as premature and an attempt to reopen a ruling that had rejected Biden’s previous attempt to dismiss the case.
Hunter Biden faces nine felony and misdemeanor charges.
Hunter Biden faces nine felony and misdemeanor charges stemming from failing to pay $1.4 million in taxes over a three-year period during which he struggled with drug addiction.
The unpaid taxes and penalties were eventually paid in full by a third party, whom ABC News identified as Kevin Morris, a lawyer and confidant of Hunter Biden.
The trial is scheduled to begin on September 5. Hunter Biden has pleaded not guilty to all charges.
