Jonathan Turley, a law professor at George Washington University, said Tuesday that Manhattan District Attorney Alvin Bragg's efforts to prosecute former Marine Daniel Penny ended up sending a “mixed message,” i.e. If you take a step to protect the people, he said, the judicial system “may come after you.”
A Manhattan jury on Monday found Penny not guilty of manslaughter in the death of Jordan Neely, after a judge dismissed the manslaughter charge against the Marine veteran. Mr Turley said Mr Penny “went through a year of hell” as Mr Bragg was prosecuted after Mr Neely died after being restrained on a New York City subway in May 2023. ” he said. “Fortunately, the result is something everyone can celebrate. But the reality is that this jury is not just speaking from their own perspective, but from the perspective of the city as a whole. I think so,” Turley told “Fox & Friends” co-host Lawrence Jones. “At the end of this process, there was a very strong voice in New York that we didn't have to leave, we could just watch.”

“But the problem here is that Mr. Bragg's message is mixed. He put this man through hell. So he put him in a criminal case, but now he's going to take a civil case brought by his family. “The question is, what was Bragg defending?” Turley continued. “Ultimately, the criminal justice system protects the most fundamental values. What are the values here? In another incident involving this CEO shooting, mayors across the city said, “This is what people want.'' It shows that we need to come forward and take action.” Well, just a few blocks away, you've just tried a guy who did just that, at least Bragg, and he went through hell for a year. ”
Police in Altoona, Pennsylvania, are launching a five-day investigation after United Health Group CEO Brian Thompson was shot and killed on Dec. 4 while on his way to a meeting just outside a Manhattan hotel. Finally, Luigi Mangione was arrested on Monday. Mr Jones asked whether Mr Penney's acquittal would end the “political prosecution”.
“Now, the question is, who exactly is Alvin Bragg's constituency? I'm sure you've seen a lot of angry and outraged voices outside the courtroom in response to this decision, but inside… even threatened Penny not to remain in New York City,” Turley replied. “But you know, beyond the mob is the rest of New York City, and they need to look at this in a broader sense. “You have a prosecutor who is in charge of this guy who should be hailed as a hero, but he was actually hailed as a hero by the people who were in that car, and you prosecuted him and fortunately other people They came forward to support him,” Turley continued. “But that's the message being sent. Don't ask for support, just move on. In fact, there's a good chance we'll come after you.”
