A Walmart delivery driver was allegedly happy at the doorstep of a South Carolina woman who had just dropped off her groceries.
Walmart Inc. and delivery driver Alvin Ortiz are named in a new lawsuit seeking unspecified damages for recklessness and negligence. Online records accessed by the Post confirm that the lawsuit was filed Dec. 19 in Horry County.
Ortiz, 39, allegedly dropped groceries on the woman's front porch shortly after 9 a.m. on July 8.
He then returned to his car, which was parked in the victim's driveway, the complaint states.
But Ortiz was in no hurry to have another baby. Instead, he allegedly sat in the car for 10 to 15 minutes.
When the woman went to check on him, she saw Ortiz with his pants down and ready to go into town.
The woman then ran back to her home and picked up her young child, according to the complaint.
They found a hiding place and called a neighbor. The person approached the car and caught Ortiz as he continued to pleasure himself.
The neighbor got into an argument with Ortiz, who then quickly drove off shouting violent threats out the window of his car.
Ortiz was arrested the following day, July 9, on suspicion of indecency. This case is still in court.
The lawsuit alleges that Walmart failed to conduct a thorough background check on Ortiz. He also said Walmart should be held accountable for the actions of its employees on the job.
In a statement to WMBF News“The safety of our employees and customers is always our top priority,” Walmart said in a statement.The company's lawyers are “reviewing the complaint and will respond appropriately to the court.”
