Rep. Tracy Mann (R-Kan.) has introduced a bill to rein in the ATF's “zero tolerance” policy, seeking to stop ATF from shutting down FFLs seemingly unchecked under former President Biden.
The title of this law is the “Regulation of Federal License Enforcement (RIFLE) Act.”
According to Mann's office,
Under the Biden administration, the ATF's zero-tolerance policy has forced small and medium-sized gun stores out of business. The agency revoked federal firearms licenses for minor clerical errors, such as omitting a customer's middle initial and using the state's abbreviation instead of its full name. In 2024 alone, the number of gun dealer license revocations by the ATF was at its highest level in 20 years, marking the third consecutive year of increased license revocations under President Biden's leadership. The Biden administration claimed last week that it was reversing the zero-tolerance policy. Upon further consideration of the updated enforcement. guidanceit seems that the effect remains completely.
Congressman Mann told Breitbart News, “President Biden has done everything in his power to weaponize the federal government against gun store owners in the Big First area of Kansas and across the country. His zero-tolerance policy. has undermined the Second Amendment and trampled on the constitutional rights of law-abiding citizens. Since day one, I have vehemently opposed this unconstitutional policy and called for increased oversight to curb ATF abuses. I have been fighting for it.”
He added: “On November 5, 2024, the nation made it clear that constitutional rights are not up for grabs. My bill would strengthen the Second Amendment rights of local gun stores. And I'm making that clear by working with President Trump to restore some sanity to individuals whose livelihoods have been destroyed by this federal abuse. further strengthened, FFL I look forward to bringing justice and getting our country back on track.”
The Rifle Act would “ensure that ATF coordinates with FFLs and give them an opportunity to comply with FFLs before ATF moves to revoke a license,” and “clearly define and enforce what constitutes a willful violation, and imposes a presumption that there is no willful violation unless it is persuasive.'' “Evidence'', “FFLs can review and appeal ATF decisions before administrative law judges, and zero tolerance Cover legal costs incurred while the policy is in force. and automatically reinstate and approve suspended, revoked, or denied licenses while ATF's zero-tolerance policy is in effect. ”
The law also provides compensation to FFLs who are victims of ATF's “zero tolerance” policy.
