McCarthy suggested that the lawsuit brought by the Attorney General and other legal challenges against Doge would not succeed as courts and Congress hold more power in terms of the administrative division than Trump. The president runs the administrative department and he has designated Elon Musk as a special civil servant. They have continues to call it “the Doge,” and is a component of the White House presidential executive branch. It's actually a refinement of what started below [former] president [Barack] Obama and they have the authority from the only person who is the president to carry out this scrutiny.
