Trump administration invokes state secrets privilege in deportation flights case

The Trump administration called for state secret privilege late Monday in a court battle over the use of alien enemy laws to deport Venezuelan immigrants, again refusing to provide details about the flight to the judge.

The call takes into account details about the state's secret flight. This seeks to limit information from District Court Judge James Boasberg, who vowed to “reach the bottom” on whether the Trump administration violated an order to turn or suspend flights.

“The court has all the facts necessary to address the issue of compliance before that. Further intrusions of the administrative department will result in the harm of dangerous and completely unfair separation in regards to diplomatic and national security concerns,” the Ministry of Justice (DOJ) wrote in its submission.

He adds that calling privileges will stop Boasberg from “clashing with executives.”

This movement occurs when Boasberg asks for a review of flight information in his room. The Trump administration wrote that Boasberg was triggered by the call, citing “the complete lack of “necessity” for information sought by the court.”

In its submission, the Trump administration once again claimed it complied with the order written by Boasburg on March 15 at 7:27pm.

However, Boasberg ordered orally about 6:45pm that day.

Both oral and written orders are binding.

The Trump administration continues to shun questions about whether it was put into oral order, saying it is merely following what was written.

“In any case, the government has already confirmed “two flights in which aliens are removed under the AEA departing US airspace before the 7:25pm EDT micro-order in the court,” the DOJ wrote Monday using the abbreviations for alien enemy law.

The American Civil Liberties Union questioned whether the government was complying with the order, and flight information shared by the Department of Justice shows flights remaining at 5:26pm and 5:45pm, suggesting that they may have turned according to the instructions.

The group argues that the Trump administration was able to comply with the orders until the moment when more than 200 Venezuelans were handed over to Salvadoran authorities and remained in jail there.
