El Salvador President Naive Bukere argued Monday that he had no capacity to send a Maryland man who had been deported to a Central American country back to the United States, despite the ruling that the US Supreme Court would direct him to “take measures to promote” his return.
“I hope I’m not proposing to smuggle terrorists into the United States,” Bukel told reporters, sitting with President Trump in his oval office. “Of course I’m not going to do that.
“The problem is ridiculous,” added Bukel. “We have no power to bring him back to the US.”
Kilmar Abrego García was sent to the infamous, brutal and overcrowded terrorism confinement centre (CECOT) with around 260 suspected gang members under the alien enemy laws of the 18th century.
The Trump administration has alleged that two lower courts have declared that Abrego Garcia had illegally entered the country in 2011.
“First and foremost, he was illegal in our country,” U.S. Attorney General Pam Bondi told reporters about Abrego Garcia on Monday. “If they want to return him, it’s up to El Salvador. That’s not up to us.”
Secretary of State Marco Rubio similarly said, “US foreign policy is carried out by the US president, not by the courts.”
“It’s where you deport people – you’re back to the country they came from,” he insisted.
However, a 2019 order from an immigration judge restricted the government from banishing Abrego Garcia to El Salvador due to concerns that it could face persecution from groups like the Barrio 18 gang.
Justice Department lawyers first admitted in court documents that Abrego Garcia’s deportation was due to “adjustment errors” and “address errors.”
White House Policy Deputy Chiefs of Staff Stephen Miller denied the claim Monday.
“That’s a big fact that most of you guys are wrong,” Miller told reporters ahead of the meeting with Bukele and Trump. “No one was sent by mistake anywhere.”
“The only mistake made is [Justice Department] The lawyer puts a false line in legal filings [and has] I’m relieved,” he said.[Abrego Garcia] It’s an illegal alien. He was deported to El Salvador. ”
A federal judge in Maryland has set an April 7 deadline for Abrego Garcia’s return to U.S. soil.
In an order handed over on April 10, the High Court directed the administration to “promote” the release of Abrego Garcia from custody in El Salvador” and ensure that his case is processed if it has not been improperly sent to El Salvador.
The Supreme Court also ruled that lower courts must show “respectful to the administrative department in conducting foreign affairs.”
In court filings Sunday, the administration argued that the Supreme Court decision did not mean that the United States had an obligation to sue El Salvador for the release of Abrego Garcia.
Therefore, “taking” all the steps available to promote Abrego Garcia’s return is best read as taking all the available measures to remove domestic obstacles that hinder the ability of aliens to return here,” said the DOJ lawyer. I wrote it in court filings Sunday.
“Indeed, other readings of “promoting” are not here, or constitutional constitutions. ”
On Sunday, Trump said 260 people had been deported.
Bukere is the first Latin American leader to win a White House visit with Trump in his second term.
