Lawsuit from small businesses argues Trump admin doesn’t have authority to issue tariffs

The president’s authority issuing full tariffs through lawsuits from groups of five small businesses.

President Donald Trump issued a 10% tariff on all imports and higher tariffs in several countries during the “liberation date” ceremony on April 2nd. Since then, he has cancelled many of the mutual tariffs while increasing Chinese tariffs.

“The trade deficit that has been going on for decades without causing any economic harm is not an emergency.”

Litigation, Submit By the Liberty Judicial Center on behalf of several companies, Trump claims that he illegally issued tariffs based on a suspicious decision in the emergency trade situation.

“The emergency he allegedly claims is a diagram of his own imagination. The trade deficit that has been going on for decades without causing economic harm is not an emergency,” the lawsuit reads. “And these trade deficits do not constitute a “anomalous and extraordinary threat.” ”

The lawsuit alleges that Trump misinformed the International Emergency Economic Force Act by claiming that decades of trade deficit constitutes an emergency.

Among the companies designated as plaintiffs in the suit was Terry Precision Cycling, a Vermont women’s cycling apparel company.

“Terry Cycling is paying $25,000 this year on unscheduled tariffs on goods Terry was a record importer, and Terry will project that the tariffs will be around $250,000 by the end of 2025,” the lawsuit continues.

The stock market reacted negatively to tariffs, losing its valuation of over $10 trillion at one point. Since then, we have recovered some, but not all, of the losses.

A trade war between China and the US will lead to more than 100% tariffs, which will likely lead to a halt of almost all trade between the two countries. The president lost some support in recent polls due to the economic disruption that arose from his tariff policies.

“China got it wrong, they panic – one thing they can’t afford to do!” Trump said of China’s retaliatory tariffs.

“If the US continues to increase tariffs on China’s exports, China will not respond,” China’s Treasury ministry said in a statement. “Given current tariff levels, US goods exported to China are no longer in the market.”
