‘US citizen arrested’ narrative hype conflicts with sworn affidavit in Hermosillo case

The recent incident in which a US citizen was arrested by the U.S. Border Patrol in Nogales, Arizona, and then released for 10 days, sparked another protest among leftists who argued that the incident, which took place for 10 days before his release, is another example of racial profiling under the Trump administration.

However, the Department of Homeland Security’s I-213 document shows that the Border Patrol has many reasons to believe that Jose Hermosillo in 2019 was not a citizen of the United States, but instead illegally crossed the southern border. Hermosillo did not have his ID when he was arrested and documents say he was not a US citizen and was illegally in the country.

AZPM It has been reported Elmosilo visited Tucson and was “lost and walked” near Nogales, an hour’s drive from Tucson when he was arrested by the Border Patrol on April 8th.

Once his family provided birth certificates and Social Security cards, Elmosilo was released and the lawsuit against him was deleted Thursday.

“He said he was a US citizen, but they didn’t believe him,” Leiba said. “I think they had him. If they hadn’t had that information in court yesterday, they would have given it to the ice and border patrols, he would probably have been deported to Mexico already.”

Despite Layva’s claims, Hermosillo apparently spoke to the agent another story. According to the I-213 form obtained by Blaze News, Hermosillo has said many times that he is a Mexican citizen and illegally crossed the southern border.

Elmosilo said he was in the US to find work and planned to stay in the country for 20 years. He allegedly had been arrested by the Border Patrol on the same day he crossed illegally.

The fact that Elmosilo appears to be a US citizen raises questions as to why he didn’t give his agents his correct citizenship information.
