House set to vote on overturning California gas car ban – defying internal watchdog

The House will vote for a resolution next week to overturn Biden-era approval of several California regulations, including a ban on new sales of gas-powered vehicles.

The vote occurs despite the fact that the nonpartisan internal watchdog has determined that it has not been overturned via a resolution under the Congressional Review Act.

Punch Bowl Previously, the home has reported that it will vote for a resolution covering California rules that limit pollution and enforce the sale of electric vehicles for cars and trucks.

A spokesman for majority leader Steve Scullies (R-La.) confirmed with Hill that the vote will take place next week.

California car rules are particularly controversial as they require all new vehicles for sale in the state, and other states that adopt the rules to make electricity or other emissions free by 2035.

The Congressional Review Act allows for the use of simple Congressional majority and presidential approval to overturn recently passed regulations.

However, the government’s Accountability Office has found that it is a nonpartisan internal watchdog that issues legal opinions, and that Biden-era approval of these rules is an exemption rather than a regulation itself, and therefore not subject to the Congressional Review Act.

Voting comes against that ruling. If the Senate refuses to make similar findings from its own Congress, approval of the resolution could pose legal and procedural challenges.

Senate Republicans said they would consider moving forward anyway after the Congressional ruling, but they didn’t make a firm commitment to do so.
