Court Allows Trump to Keep Authority Over California National Guard

Trump Maintains Control of California State Guard

A recent federal appeals court ruling has required President Donald Trump to retain control over the California State Guard. This decision came down on a Thursday evening.

Previously, Judge Charles B. Breyer, appointed by Clinton, had mandated that Trump assume authority over Governor Gavin Newsom’s administration. This followed an incident where Trump deployed the National Guard to Los Angeles to address riots that impeded his ability to carry out immigration enforcement via ICE.

The Ninth Circuit recognized the president’s legal powers, stating, “It is highly likely that the president has legally exercised his legal authority.” The court noted that even if there were procedural missteps, it wouldn’t account for the level of remedy sought by the District Court’s temporary restraining order.

Furthermore, the judges opined that the federal executive order regarding the California State Guard appears to be valid under §12406(3) and addressed the 10th amendment concerns raised in the case.

The panel consisted of three judges: Mark J. Bennett and Eric D. Miller, both appointed by Trump, and Jennifer Son, who is a Biden appointee.

This ruling is viewed as a significant win for Trump regarding his powers to call upon the National Guard. He responded to the decision on his platform, stating, “The judge clearly saw that Gavin Newsom is incompetent, but this transcends his leadership. If our cities and people need protection, we owe it to them, especially when local police are unable to manage.” He expressed gratitude towards the 9th Circuit, declaring pride in America for the ruling.

Newsom, in response to the court’s decision, emphasized on social media that Trump is “not a king” and must adhere to the law. He asserted that the court correctly dismissed Trump’s arguments, insisting that they would not allow misuse of military force against citizens to go unchecked.
