Rep. Andy Barr Proposes Amendment to Clarify Birthright Citizenship
Rep. Andy Barr from Kentucky, amidst ongoing legal disputes between President Trump and various Democratic states over birthright citizenship issues, has introduced a constitutional amendment aimed at clarifying the 14th Amendment. He believes it’s crucial for protecting America.
If this amendment passes, it would assert that only individuals “subject to jurisdiction” in the U.S. can be considered citizens. The original 14th Amendment, passed in 1868 to ensure citizenship for former slaves, declares that “all persons born or naturalized in the United States, and subject to its jurisdiction, are citizens.”
In an interesting turn of events, the Trump administration has also ended temporary protected status for Haitian immigrants currently residing in the U.S.
This proposed amendment would clearly state that “people born in the United States may be considered under U.S. jurisdiction.” Essentially, if a child is born to parents who are in the U.S. illegally, that child would not gain citizenship.
Interestingly, this push for amendment comes shortly after the Supreme Court made a ruling favoring Trump, allowing lower courts to issue injunctions only in specific cases. Yet, the broader question of the constitutionality of birthright citizenship remains unresolved.
On another note, 37 House Democrats have sided with Republicans on a measure to deport illegal immigrant drunk drivers, showing an unexpected crossover in party lines on immigration issues.
The Supreme Court has agreed to review multiple cases this term related to nationwide injunctions imposed by federal judges from Maryland, Massachusetts, and Washington, who had previously hindered Trump’s efforts to address citizenship rights.
While the recent discussions haven’t focused deeply on the merits of these universal injunctions, the court’s latest ruling doesn’t clarify whether the birthright citizenship directive is constitutional.
In a statement, Rep. Barr expressed his gratitude towards the Supreme Court for limiting injunctions but emphasized that they cannot afford to wait to terminate birthright citizenship.
Barr firmly stated that the radical district judges have impeded the MAGA agenda through national injunctions, causing substantial setbacks in Trump’s efforts and vowing to push for constitutional amendments to settle this debate once and for all.
