ACLU Put Forward ‘Complete Nonsense Argument’ in Trans Athletes Supreme Court Case

Terry Schilling, the head of the American Principles Project, foresees a win for the Supreme Court regarding state laws that prohibit men, including those who identify as transgender, from participating in women’s sports.

In the legal action, transgender male athletes contested these laws in Idaho and West Virginia, with the American Civil Liberties Union (ACLU) and Lambda Legal providing representation. Schilling mentioned in an interview with Breitbart News Saturday that the ACLU contended the law discriminates based on gender and sidesteps a clear definition of sex, leading to the case being brought to court.

“What the left and the ACLU claim is that preventing biological males from competing in women’s sports amounts to sex discrimination, violating both the 14th Amendment and due process,” Schilling said. “It’s a totally flawed argument. We made our stance clear ages ago. We initiated a series of laws called Title IX aimed at ensuring equal opportunities for women in education, extending to sports as well.”

“Since the ACLU does not accept a definition of gender, it’s tough to argue that this situation is truly about sex discrimination,” he further explained. “Defining sex legally complicates things and essentially invalidates the entire transgender debate. The transgender movement asserts that sex isn’t real—only gender identity matters, and it should take priority over everything else.”

Schilling also dismissed gender ideology as “completely absurd.”

“Men and women aren’t just different; they are actually opposites. They complete each other. Where men tend to struggle, women usually excel, and vice versa. That’s a beautiful dynamic, the essence of our society, and how we continue to thrive,” he expressed.

“I’m confident we’ll prevail. I believe the Supreme Court has consistently ruled in favor of traditional views on transgender issues over the past few years,” he added.

It’s also important to point out that the Supreme Court has made several rulings recently that have restricted the agenda of transgender activists, including allowing states to ban gender reassignment for minors and enabling parents to opt out of LGBTQ+ content in school curricula. There has also been skepticism in the court regarding Colorado’s ban on “conversion therapy.” A decision regarding the transgender athlete’s lawsuit is anticipated this summer.

Schilling stated, “We aim to push forward and pass national legislation to safeguard women’s sports nationwide, as there’s no reason a girl from a blue state like California or New York shouldn’t have the same rights as one from Texas or Indiana.”

He also noted polling indicates that men’s participation puts them at a significant advantage in women’s sports, suggesting that Democrats who support this issue are in a precarious position ahead of the midterms. He urged Republicans to take this matter seriously this year, akin to how President Trump handled it in the 2024 elections.

“What Republicans ought to do is emphasize that electing Democrats won’t result in lower taxes or provide any more financial relief. Instead, they will raise taxes, increase utility bills, and push boys into girls’ sports. That’s their priority,” he said.

“They focus more on having boys in locker rooms and showers alongside girls than on serious parental rights concerning healthcare decisions. Democrats need to highlight that they care more about culture wars than any pressing issues like economics or public safety. Their goal seems to be pushing transgender ideology on children rather than actually helping the country. I believe we can hold both houses in Congress.”
