California Regulators Apologize to SpaceX Following Settlement
California regulators recently issued an apology to SpaceX CEO Elon Musk. This came after a lawsuit that claimed the regulatory agency displayed political bias against the rocket company and its leader was resolved.
As a part of the agreement, the California Coastal Commission recognized that its members made “inappropriate” remarks regarding Musk’s political views during a hearing in 2024 concerning the Falcon 9 launch plan.
“The commission agrees to refrain from taking extraneous factors into account. Specifically, it commits to not considering what it perceives as the political beliefs, political speech, or labor practices of SpaceX or its executives in regulatory decisions relating to the company,” stated a federal court document submitted on Tuesday.
SpaceX had taken legal action against the commission for opposing an expanded launch schedule for Falcon 9 rockets from Vandenberg Space Force Base, which is located on the Southern California coast near Santa Barbara.
The lawsuit accused the Coastal Commission of exercising political discrimination by declining to approve a U.S. Air Force proposal to increase the number of launches at the busy federally owned site. The complaint went as far as to allege that board members voted against SpaceX due to their disapproval of Musk’s distinct political opinions, essentially violating his rights to free speech and due process.
The proposed settlement suggests that the lawsuit will be permanently dismissed. However, both parties have agreed that this deal does not indicate any form of “liability or wrongdoing.”
The commission also confirmed that no coastal development permits would be necessary for SpaceX’s launch plans within the state.
Representatives from SpaceX did not respond quickly to requests for comments regarding the settlement.
In a statement on Wednesday, the Coastal Commission acknowledged making apologies for the “irrelevant” comments from its members and expressed ongoing concerns about the potential effects of increased rocket launches on coastal resources.
“These impacts include limitations on public access to beaches, harm to sensitive species and coastal habitats, along with the frequency and severity of sonic booms,” the statement continued. “Federal law mandates that the federal government must consult with the Coastal Commission on such matters. However, the federal government has yet to provide adequate information to the Coastal Commission concerning these activities and their repercussions on the California coast.”
This settlement coincided with another legal conflict involving Musk, particularly relating to his ongoing challenges with co-founder Sam Altman of OpenAI.
