California to Sue Trump Administration Over Auto Emissions

California plans to file a lawsuit against the Trump administration on Monday. This legal action comes after the Environmental Protection Agency (EPA) decided to submit the state’s longstanding auto emissions exemption to Congress for review. This situation could lead to a legal battle that will define California’s influence on the U.S. auto market.

The lawsuit, led by California Attorney General Rob Bonta, contests the EPA’s choice to present four of California’s emissions waivers to Congress under the Congressional Review Act, which allows lawmakers to potentially overturn certain federal regulations.

The EPA chose not to comment on the lawsuit but, in a recent press release, expressed its commitment to promoting consumer choice and ensuring affordable vehicles while adhering to the law.

California argues that this measure undermines its authority to impose stricter vehicle emissions standards than what federal regulations stipulate under the Clean Air Act. The state also notes that numerous other states have adopted its emissions standards, thereby extending its influence beyond its boundaries.

The core issue at play is the EPA’s recent decision to submit exemptions related to vehicle emissions and lawn and garden equipment to Congress for review.

California contends that the EPA is improperly attempting to change previously treated exemptions into regulations open to Congressional reversal. This is, I think, a significant shift in how agency decisions are handled.

This legal clash represents yet another confrontation between California and the Trump administration regarding environmental policies and vehicle emissions standards.

Last year, President Trump and Republican lawmakers invoked the Congressional Review Act to nullify California’s electric vehicle sales mandate and diesel engine regulations. California subsequently took those actions to court.

The resolution of this latest lawsuit could have far-reaching implications. It may determine whether Congress can more readily roll back environmental policy through the Congressional Review Act. More importantly, it could influence California’s ability to continue using federal exemptions to shape emissions standards that other states may also adopt.
