California Senate Passes Controversial Bill Targeting ICE Officers
The California Senate approved a bill on Thursday, spearheaded by Scott Wiener, a Democrat from San Francisco, which seeks to prohibit federal Immigration and Customs Enforcement (ICE) officers from wearing masks. This legislation is part of a broader national endeavor that many argue facilitates targeting ICE personnel and their families by leftist activists.
This particular bill raises constitutional concerns, as it may struggle to survive under federal law, given that state police are typically unable to enforce laws against federal law enforcement due to supremacy clauses. Additionally, it seems to grant illegal exemptions to the California Highway Patrol, a unit that has been tasked with protecting former Vice President Kamala Harris. Critics assert that such discrimination against federal officials could breach the Equal Protection Clause of the 14th Amendment.
However, like many of California’s notable laws, the intention here appears to be more about sending a message than about practicality. Specifically, the bill expresses opposition to federal immigration policies and, arguably, opens the door for radical protests and unrest.
Wiener has a history of sponsoring progressive legislation in California, contributing to the state’s reputation as a sanctuary for certain contentious issues, including transgender surgeries for minors and even the decriminalization of loitering for the purpose of street prostitution. The latter has sparked considerable backlash due to its association with increased street prostitution involving trafficked minors, prompting a repeal of the law not long after its introduction.
On the day the bill progressed through the Senate, Wiener made headlines for denouncing Charlie Kirk, who had recently been the victim of a shooting, illustrating the tensions surrounding the bill’s passage. It’s noteworthy that the legislation does not specifically address the actions of protesters who disguise their identities with masks, nor does it seem to confront illegal activities perpetrated against federal law enforcement while wearing such disguises.
As Governor Newsom prepares to decide on this bill, he faces a pivotal choice: should he align with his party’s anti-ICE factions or risk backlash by standing in support of federal officers? This decision could have implications as he eyes a presidential run in 2028.
