‘Catastrophic’: Andy McCarthy Tells Panel This Overlooked Case Could ‘Blow Up’ Jack Smith’s Prosecution

Former federal prosecutor Andrew McCarthy said Monday that many people are “overlooking” the case, which will make “a big deal” for Special Counsel Jack Smith’s prosecution of former President Donald Trump.

In August, Smith secured four charges against Trump in connection with the former president’s efforts to contest the results of the 2020 election. The Supreme Court has agreed to hear Fisher v. United States, the obstruction statue-centered case that Smith brought against Trump in his August indictment, and oral arguments are scheduled for April. “The notable case is the obstruction case,” McCarthy told “America’s Newsroom” co-host Bill Hemmer. “It’s unfortunate because President Trump is not a party to that case. They are considering the same law that will be key to Mr. Smith’s prosecution of Trump in Washington, but if they — as I predict They may do so — but if they argue that the Justice Department is not applying the law correctly, that would create serious problems. Mr. Smith’s indictment could have devastating effects ”
