Daniel Penny chokehold did NOT cause Jordan Neely to die, defense expert testifies

A Texas forensic pathologist called by Daniel Penny's defense team testified Thursday that Penny's strangulation of Jordan Neely was not the sole cause of his death, according to a Manhattan medical examiner's statement. contradicted.

Penny's lawyer, Stephen Reiser, directly asked Dr. Satish Chundru if strangulation was the cause of Neely's death, and Dr. Chundru said “no,” the New York Post reported. Ta. reported. Chundru said there were other contributing factors to Neely's death, so he ruled out air asphyxia and blood asphyxia.

Harris initially called Neely's cause of death “inconclusive.”

Tundor pointed to other details in Neely's medical records, including bruises on Neely's neck and a small, “almost negligible” spot of bleeding found on her eyelid, which could have been fatal. Tundor argued that this was not consistent with strangulation.

Tundor said Neely died from “the combined effects of sickle cell crisis, schizophrenia, struggle and restraint, and synthetic marijuana,” adding that schizophrenia poses an “increased risk of sudden cardiac death.” he pointed out. Neely threatens to kill him, saying he doesn't care if he goes to jail, so Penny puts Neely in a chokehold, scaring many of the passengers.

Chundru also pointed out that K2, the synthetic marijuana Neely used before making the death threat on a subway train last year, was the only cause of death in other incidents he witnessed.

Dr. Cynthia Harris, who performed Neely's autopsy, previously told jurors that she did not wait until a toxicology report declared Neely's cause and manner of death to be asphyxia rather than cardiac arrest. Ta. She said she was strongly convinced that Penny murdered Neely and would support Penny's conclusion even though Neely had an amount of drugs in his system “enough to knock down an elephant.”

Harris initially called the cause of Neely's death “inconclusive,” but after watching the video, he changed the cause and determined Neely's death was due to “asphyxia.” That's because, in her opinion, the video shows Neely “nearly dying” as Penny grabs her and suffocates her. .

“After I saw that, I had no further questions about how he died,” Harris testified. Because “there is no reasonable alternative explanation.”

Penny was charged with second-degree manslaughter and criminally negligent homicide by Manhattan District Attorney Alvin Bragg's office. If convicted, Penny could receive 15 years in prison.
