DHS urges NY AG to respect ICE detainers following 6,947 criminal releases

The Department of Homeland Security (DHS) has reached out to New York City Attorney General Letitia James, urging her to address the city’s management of illegal immigration. There have been claims that since January 20, 6,947 criminals who are undocumented immigrants have been released due to the city’s lack of cooperation with Immigration and Customs Enforcement (ICE). An additional 7,000 are reportedly being held in New York.

In a letter, DHS emphasized the need for James to take action, stating, “This is common sense.” However, in response, James’s office directed inquiries to a previous letter she sent to Todd Lyons, the acting director of ICE, which indicated that her office doesn’t typically handle detainer requests because they seldom take individuals into custody.

Lyons’s recent correspondence outlined criminal activities among individuals in New York custody. He highlighted cases involving serious crimes like murder and sexual assault, arguing for their swift removal from the U.S. upon release from New York’s custody. For instance, one individual mentioned was Steven Daniel Enriquez Galicia, arrested for attempted murder. He is currently in federal custody after being detained by ICE.

Another case cited is that of Vyacheslav Danilovich Kim, who had a history of serious sexual offenses and had previously been convicted. Despite attempts by ICE to detain him, local authorities had been uncooperative until he was eventually arrested in 2024.

Assistant Secretary of Homeland Security Tricia McLaughlin voiced concerns about the release of dangerous individuals back into communities, stating that politicians in New York are jeopardizing public safety. She insisted that those who commit crimes should not be allowed back onto the streets.

The discourse around immigration enforcement has sparked significant protests, especially in Chinatown, where ICE operations have led to disturbances. Recent protests saw multiple arrests as demonstrators clashed with police, obstructing streets and antagonizing law enforcement.

The situation continues to evolve, and it remains to be seen how both state and federal leaders respond to these growing tensions.
