Grieving Family Awarded $2.25 Million After Autopsy Photo Controversy

A Georgia family has been awarded $2.25 million after a judge found that an Atlanta pathologist had violated their privacy by sharing autopsy photos of their deceased infant on social media. The ruling came from a Fulton County judge who ordered Dr. Jackson Gates, along with his company, the Gates Rapid Diagnostic Laboratory, to pay $250,000 in both compensatory and punitive damages to the parents.

The tragic events unfolded when Jessica Ross, the baby’s mother, faced complications during childbirth on July 9th, necessitating an emergency cesarean section. Unfortunately, the baby did not survive.

After the birth, Ross and the father, Treveon Taylor Sr., filed a lawsuit against Southern Regional Medical Center and the medical staff, alleging that improper handling during delivery had contributed to the baby’s death. They claimed that medical professionals had pulled their baby’s head in ways that endangered the skull and neck, leading to fatal injuries.

Events took a disturbing turn when, a few weeks post-tragedy, Dr. Gates performed a private autopsy at the couple’s request. He allegedly shared graphic images of their child’s remains without their consent, posting them on Instagram. Ross expressed her horror at the situation, saying, “My baby was on Instagram. Dr. Gates posted a photo of my baby.”

The couple’s lawsuit, filed in September 2023, accused Gates of reposting the photos and disregarding their requests to remove them, asserting that the images served an educational purpose and that their child was unidentifiable.

In a statement after the ruling, the couple’s lawyer expressed relief that the judge held Dr. Gates accountable. However, they acknowledged that such a judgment could not alleviate the deep sorrow the family experienced from losing their child in such a traumatic manner. The attorney stressed that the aim was to ensure accountability for the serious invasion of privacy.

As for the investigation, the Clayton County Medical Examiner’s Office had earlier ruled the death a homicide. Meanwhile, the family’s lawsuit against the hospital and the medical staff responsible for the delivery is yet to proceed in court. Southern Regional Medical Center has not commented on the case, nor have Gates’ attorneys made any public statements regarding the ongoing situation.
