Justice Department Supports Elon Musk’s xAI Lawsuit Against Colorado

The Justice Department has allied with Elon Musk in a legal battle initiated by his company, xAI, against Colorado. The lawsuit claims that a forthcoming state law regulating artificial intelligence developers is an insidious attempt to impose diversity, equity, and inclusion (DEI) standards on these platforms.

Harmeet Dhillon, who leads the Justice Department’s civil rights division, stated that this marks the department’s first constitutional challenge related to AI. The accusations from xAI and the Justice Department argue that the Colorado law, which is anticipated to come into effect in June, contravenes the First and 14th Amendments. They assert that it compels AI developers to implement discrimination—a claim that is not entirely new for Colorado, which has seen multiple legal setbacks in similar culture-related disputes in recent times.

“We join @xai’s landmark lawsuit to oppose the woke DEI standards Colorado is imposing,” Dhillon remarked.

Colorado’s Recent Legal Challenges

The lawsuit is rooted in a controversial consumer protection law passed by Colorado’s Legislature in 2024. This legislation mandates that “high-risk” AI developers, like xAI—known for its Grok platform—must exercise “reasonable care” to protect consumers from “algorithmic discrimination.” Essentially, it prohibits AI tools from causing discrimination against protected categories like race or religion. Musk launched xAI in 2023.

The law also encompasses various entities that utilize AI tools, including hospitals and banks, with the intention of ensuring fair treatment for consumers in those sectors.

Democratic Governor Jared Polis reluctantly signed this bill, which is set to be implemented in 2024. Concerns have arisen that the regulations might threaten the position of the state’s technology innovators. FOX News Digital has attempted to contact Polis’s office for a statement regarding the Justice Department’s involvement in this case.

The Justice Department’s lawyers argue that this Colorado law could potentially foster discrimination, citing clauses that might allow AI developers to favor specific demographics “to enhance diversity or rectify historical wrongs.”

Concerns About Constitutional Compliance

The law is perceived to jeopardize the United States’ stature as a leader in AI, forcing systems to adopt a discriminatory mindset that prioritizes demographic characteristics over objective, merit-based results, according to government attorneys.

While the Justice Department’s complaint mainly highlights violations relating to equal protection, Musk’s xAI also claims numerous constitutional breaches, including viewpoint discrimination. xAI’s legal representatives contend that the law coerces developers into incorporating “progressive ideology.” They argue, “By requiring ‘developers’ and ‘adopters’ to differentiate between discrimination Colorado approves of and that which it does not, SB24-205 compels Plaintiff xAI to modify Grok’s outputs to align with controversial viewpoints selected by the state.”

On another note, a law firm stated that Colorado represents a “national test case” for AI consumer protection, being the first state to pass such comprehensive legislation. The implications of this law may further illuminate the extent to which constitutional rights can be challenged.

In recent rulings, including an 8-1 decision where the Supreme Court found Colorado’s anti-conversion therapy law unconstitutional, a trend has emerged indicating the state’s regulatory stance on discrimination. Earlier court decisions have also often reinforced the notion that Colorado has robust opinions on what constitutes harmful speech.
