The Gun Owners Association of America (GOA) and the Gun Owners Foundation (GOF) joined Texas Attorney General Ken Paxton in suing Biden’s ATF over new rules requiring background checks on private gun sales.
Breitbart News reported that the ATF released the proposed rule on August 31, 2023. The rule would redefine what it means to be “in the business of selling firearms,” which would expand the number of unlicensed sellers, or civilians, selling firearms. . You must use NICS to sell or transfer guns.
Although the rule primarily focuses on guns sold for “profit,” pages 26-27 equate “financial gain” with “profit,” leading to ATF requiring NICS. This opens up possibilities for redefining the word “sales.” Check to see if private sellers are “bartering” for guns.
Page 194 of the 466-page rule clarifies that, following the ATF’s redefinition, anyone who smuggles guns out of the country for the purpose of selling them overseas also falls under the category of “dealer.”
From the rules:
An unauthorized person who purchases a firearm in the United States and smuggles or transports it outside the United States for sale in another country (or conspires to do so, or attempts to do so) is subject to 18 USC 924(k)(2) ( B) violates. OTHER PROVISIONS OF UNITED STATES LAW. This is not an activity “wholly outside the United States”… Therefore, the rule now states that in the definition of “dealer,” the purchase or sale of firearms as a wholesaler or retailer must be “completely outside the United States.” “It may be carried out at a public or private facility.” market or premises. ”
The rule uses a combination of redefined terminology and ambiguity to sidestep law-abiding citizens and direct them to the National Instant Criminal Background Check System (NICS) for private gun sales.

But GOA, GOF, and the state of Texas filed suit. are discussing This rule would protect “hundreds of thousands of law-abiding gun owners from criminal convictions for all types of activities related to the private sales of harmless, legally sanctioned, and constitutionally protected firearms.” “It will be estimated that
ATF used the bipartisan Safe Zones Act, a gun control bill authored and brokered by Sen. John Cornyn (R-S.C.), to justify its background check rules.
Eric Pratt, GOA Senior Vice President, said:
We warned Americans that this bill brokered by Sen. Cornyn is no small compromise. And today, we are filing a second lawsuit challenging key policies derived from that gun control law.
Criminalizing countless Americans simply for selling firearms in private transactions is wrong, unconstitutional, and must be stopped by the courts. Anything less would further encourage this overbearing administration to continue weaponizing vague legislation as a policy designed to further harass and intimidate gun owners and sellers at every turn. Dew.
“Once again, Joe Biden is weaponizing the federal bureaucracy to tear apart the Constitution and destroy people’s Second Amendment rights,” AG Paxton said. This is a dramatic escalation of his arrogant abuse of power. We are honored to have today’s lawsuit protect our constitutionally protected freedoms from an out-of-control federal government. ”
