GOP official advises Fairfax prosecutor to stop commenting on child rape case

A recent House Judiciary subcommittee meeting turned chaotic when a lawmaker from North Carolina demanded that Fairfax County Attorney Stephen Descano “shut up.” This confrontation came amid discussions about several serious cases, including one involving the alleged rape of a four-year-old girl by an undocumented Guatemalan immigrant.

During the hearing, Descano, along with Sheriff Stacey Ann Kincaid—who has faced criticism for not cracking down on suspected illegal immigrants—engaged in heated exchanges with lawmakers. Some legislators referenced the prosecutors’ written policies and campaign commitments regarding immigration-related consequences affecting prosecutorial choices.

Descano disagreed with assertions made by Representatives Brad Knott and Brandon Gill, both from Texas, who were critical of attorneys with ties to George Soros overseeing prosecutions in Virginia’s largest city. Knott pressed Descano on whether he would handle a particular case with the community’s safety in mind. Though Descano affirmed this, his frustration was evident.

Knott recalled the case of Hiram Baquedano Rodriguez, a Honduran national released by an immigration judge under the Biden administration. This individual was later charged with a troubling incident involving a young girl. The lawmaker described how the girl’s mother found her distressed and injured, which Knott suggested may have been a kidnapping attempt.

According to Knott, Fairfax County police had enough evidence to warrant serious charges like attempted murder and rape, which could lead to lengthy prison sentences. Yet, Knott stated that Descano had lightened the charges significantly after the case reached his office, reducing a robbery charge to a misdemeanor and dismissing other serious allegations.

As the tension escalated, Descano expressed his dedication to community safety. Still, Knott called him a “coward” for how he managed child safety cases based on what he described as lenient treatment toward repeat offenders.

The atmosphere grew increasingly confrontational. Descano tried to interject multiple times, prompting Knott to insist on being heard, especially concerning the gravity of the allegations against Rodriguez. Knott stressed the severity of pulling a child from her bed for nefarious purposes.

In a turn of events, Knott sought input from former Virginia Republican Attorney General Miyares about the possible release of the suspect after Descano’s office dismissed the case. Miyares confirmed that the individual was indeed free.

Further discussion continued with Representative Gill posing questions about Descano’s policies, focusing on instances where prosecutors needed to consider the immigration ramifications of crimes. Descano defended his stance, stating that his references to policy were part of his campaign declarations before being pushed by Gill on the particulars of a related case involving another Guatemalan national.

Gill’s inquiry highlighted how charges against a defendant in a sexual case were minimized, raising concerns about Descano’s approach to handling cases linked to immigration status. In the instance of Baquedano-Rodriguez, the ICE Washington Field Office director stated that they eventually apprehended the suspect after his release, emphasizing their commitment to removing criminal aliens from the region.
