The Heritage Foundation has filed a Freedom of Information lawsuit (FOIA) against the Department of Homeland Security (DHS) for records related to Vice President Kamala Harris' role as so-called “border czar.”
The lawsuit, investigated exclusively by Breitbart News, asks a federal judge for a preliminary injunction requiring the Department of Homeland Security to turn over all records showing Harris's time as border chief and her role in combating illegal immigration by September 21, just before the November presidential election.
“On April 14, 2021, President Joseph R. Biden announced that he was appointing Vice President Harris to serve as, reportedly, 'border czar.' In effect, this meant that Vice President Harris would be responsible for overseeing and coordinating border security policy and operations,” the lawsuit states.
However, there has been considerable confusion about whether Vice President Harris was in fact the border secretary and, conversely, whether she was responsible for the Biden-Harris administration's immigration policy fiasco. The Biden-Harris Administration's open border policies have led to a porous and dangerous border and a broader migration crisis. It is widely recognized that the Biden-Harris Administration's border policies have been a huge failure, and according to some reports, even the Vice President himself has acknowledged this failure. The FOIA request states:[a] Extensive and exceptional media interest There may be questions that affect public confidence in the integrity of the government.” [Emphasis added]
Whether Vice President Harris is in fact the border secretary could raise questions about the government's integrity, which will affect public trust in both the Biden-Harris administration and the Trump administration. “The Biden-Harris administration has sought to downplay her responsibilities on border security and immigration enforcement since becoming the party's presidential nominee. The lawsuit has even been covered in the media. [Emphasis added]
In particular, Heritage's lawsuit seeks to determine whether Harris is called “Secretary for Border Affairs” within the Department of Homeland Security and what role she plays in dealing with illegal immigration, whether she is fit to be president, and if Harris is not called “Secretary for Border Affairs,” which government officials are responsible.
“The request goes straight to the heart of the matter and seeks all records that contain the terms 'Border Czar' and Harris,” the complaint continues.
These issues are extremely important to the American people. They have a right to know who is in charge of the Biden-Harris administration's widely criticized border policies. These questions are also being scrutinized in Congress. The question of who is responsible for the Biden administration's failed border policies has attracted “extensive and unusual” media attention. And the question of the Biden-Harris administration's accountability for its border policies is rife with questions about the government's integrity. [Emphasis added]
Plaintiffs' right to injunctive relief couldn't be clearer. Plaintiffs have been completely denied their statutory rights regarding timing and priority. And at the heart of this lawsuit is one thing: the records requested relate to critical issues in the 2024 general election, and therefore the American people should be able to see them before the polls open. With a significant amount of voting underway by September 21, 2024, Without an order compelling the production of all non-exempt records, plaintiffs, and ultimately the American people, will suffer enormous and irreparable harm.
