The Trump administration expressed concerns on Wednesday regarding California’s “sanctuary” policy, which permits the release of undocumented immigrants with criminal backgrounds from prison back into communities.
A letter from ICE addressed to Governor Gavin Newsom and his administration inquired whether California would comply with requests to have local law enforcement detain certain immigration detainees, those who might soon be released following arrest or after serving their time.
The letter, which was leaked, asked, “Can you confirm if California intends to respect the requests regarding these individuals, or will they—dangerous individuals—once again roam the streets?”
As a sanctuary state, California generally prohibits state and local authorities, including police and schools, from seeking out someone’s immigration status or sharing that information with federal immigration agencies like ICE.
ICE Director Todd Lyons criticized California’s policies, asserting that they jeopardize public safety by releasing individuals engaged in serious crimes back into neighborhoods.
A spokesperson for the Department of Homeland Security noted that because of these sanctuary policies, federal agents often need to conduct arrests in communities, as they aren’t notified that illegal immigrants are being released.
“We just want the states to hand over individuals for deportation once they’ve served their sentences,” remarked the spokesperson.
The federal government claims that approximately 4,500 criminals who are undocumented have been released on California streets. According to the letter, tens of thousands of undocumented immigrants, having previously committed crimes such as murder and drug offenses, are currently or recently detained in the state.
ICE detailed high-profile cases, including a Guatemalan convicted of first-degree murder and an Armenian found guilty of voluntary manslaughter, emphasizing that these detainees were not managed properly, leading to their release back into society.
Amidst rising tensions, anti-ICE protests have surged in California, particularly following the shootings of individuals linked to ICE. The discord has been exacerbated by Governor Newsom’s promotion of legislation that restricts law enforcement officials, including federal agents, from wearing masks while on duty in the state.
This letter signifies ongoing confrontations between the state and the federal government over immigration policies. California hasn’t responded to the recent communication.
