‘Impaired’ Roswell man threatened to shoot Arby’s workers after they refused to give him free milkshake, police say

New Mexico State Police Said A Roswell man appeared to be in an “intoxicated” state when he threatened to shoot a fast-food worker over a milkshake, police said.

Tommie Smith, 56, has pleaded not guilty to the incident, which happened in April.

“He told the workers he would shoot them with a gun he had in his backpack.”

A fast-food employee told police that Smith appeared to be in a “disoriented state” when he walked into the Arby’s in the 1300 block of North Main Street and asked for a milkshake.

Employees told police that after Smith was asked if he was willing to pay, he responded that he wanted a free milkshake.

When employees refused, Smith clenched his fists and walked into the bathroom, according to employees, and emerged telling employees he would shoot them with a gun he had in his backpack if they did not comply with his demands.

Police arrived on the scene after workers called to report a man causing a disturbance and slurring his speech.

When police arrived on the scene, they found Smith sitting at a table, staggering and appearing disoriented, and no gun was found in his backpack.

The police arrested him Charged Smith was charged with attempted robbery, disorderly conduct and public nuisance. He was booked into the Chaves County Jail. Chaves County Magistrate Court Judge KC Rogers set bail at $2,500.

Roswell is a city of about 47,000 people in southeastern New Mexico best known for UFO conspiracy theorists who believe an extraterrestrial lifeform crashed here in 1947.
