Department of Education Investigates LAUSD Policies

The U.S. Department of Education’s Office for Civil Rights has initiated a formal inquiry into the Los Angeles Unified School District (LAUSD) to evaluate whether its policies regarding teacher sexual misconduct align with federal law.

This investigation centers on a settlement reached in 2024 between LAUSD and the United Teachers Los Angeles (UTLA). The settlement arose from a complaint filed by the union in late 2023 concerning the process for reassigning teachers accused of misconduct.

Federal officials have raised concerns that the agreement lacks key protections, especially failing to explicitly bar these educators from working in roles that involve direct interaction with students during the investigation. This has led the Department to examine whether LAUSD’s current practices sufficiently safeguard students as mandated by Title IX.

“Under Title IX, schools are required to respond appropriately and address allegations of sexual misconduct, including sexual harassment and assault, in a timely manner, but the district appears to be prioritizing the continued employment of sex offenders over the safety of students,” said Kimberly Ritchie, Assistant Secretary for Civil Rights.

Title IX, part of the Education Reform Act of 1972, serves as a cornerstone of federal civil rights law, prohibiting discrimination based on sex in federally funded education programs and activities. This requirement covers more than just athletics and admissions—it’s also about ensuring the safety and fair treatment of all students and staff. The Office for Civil Rights provides oversight and guidance to schools on the necessary administrative measures to take when allegations arise.

This guidance includes delineating legal standards that direct how school districts should handle the reassignment or removal of staff in order to maintain a safe learning environment while investigations are underway.

In response to the federal announcement, LAUSD labeled the government’s claims as “untrue.” The district explained, “’Reassignment’ typically means that the employee is directed to remain at home and away from students and school during the investigation. Reassignment decisions are based first and foremost on the safety of students, staff, and the workplace.” Ritchie, however, countered, “It is unconscionable that a school district would simply ignore Title IX’s procedural requirements to protect teachers who cause life-altering harm to children.”

While the exact number of educators affected by the 2024 settlement remains unclear, as do the specific school locations involved, the implications for LAUSD are considerable. The federal review will scrutinize whether the district’s internal procedures align with Title IX’s requirements.

If the investigation finds that LAUSD is not compliant with these civil rights standards, the district could face significant repercussions, including the loss of essential federal funding and the necessity for extensive policy revisions to ensure future compliance and student safety.
