Court Hearing on Immigrant Deportation Situation

A U.S. District Judge, Paula Sinis, has instructed lawyers from the Department of Justice and Kilmar Abrego Garcia, an immigrant from El Salvador, to appear for another court hearing on Friday. This follows Abrego’s legal team’s attempts to halt the Trump administration’s plan to send him to a third country as soon as next week.

Sinis emphasized the need for further discussion at 5:30 PM regarding the objections raised by Justice Department attorneys, indicating a lack of empathy for their situation.

She remarked that a witness brought by the government took significantly longer to testify because he seemed uninformed about the case. “It’s about the government,” she asserted. “If you want to discuss it now, we can.”

The court convenes again at 9 AM on Friday to continue the arguments.

Federal Judges Halt Birthright Citizenship Ban

During the recent proceedings, Sinis also entertained the idea of a temporary restraining order. The government would have to ensure that Abrego Garcia is held in custody for at least 48 hours prior to any potential removal. She specified that he must remain in a local immigration detention facility, rather than being transferred to a more remote location.

“However,” she added, “I’m not going to permit Abrego Garcia’s outright release,” especially if he’s released from custody in Tennessee next Wednesday. She expressed concerns over discrepancies in the timelines discussed during the previous court session.

These remarks followed a full day of court testimony from Thomas Giles, the assistant director of ICE’s Enforcement and Removal Operations Bureau.

Judge Sinis requested the government to provide specific details from witnesses who possess firsthand knowledge about Abrego Garcia’s case.

Prosecutors Plan to Remove Abrego Garcia

Not much information was revealed during the hearing. Giles mentioned that he learned about his participation in the proceedings at 7:47 AM on Tuesday, and he wasn’t able to share substantial details regarding plans to deport Abrego Garcia. Sinis appeared astonished by the lack of information from Giles, especially given his senior position. She indicated plans to continue questioning him on Friday.

Sinis dismissed objections from two Justice Department lawyers, who were unable to arrange their schedules for the hearing. “I have 400 cases,” she pointed out succinctly.

The recent request for a hearing arose after Justice Department officials indicated that Abrego Garcia could be deported as soon as July 16, depending on whether a federal judge in Tennessee would release him.

Abrego Garcia was recently returned to the U.S. from El Salvador, following his imprisonment there. He had served federal charges linked to a 2022 traffic incident. Justice Department officials aim to transfer him to ICE custody shortly and expel him to a third country, regardless of his ongoing legal situation.

Judge Questions Timing of Investigation

Sinis probed Trump administration lawyers on when the federal investigation into Abrego Garcia began, wanting to clarify if it coincided with the charges filed.

A Justice Department lawyer, Jonathan Ginn, indicated to Sinis that they won’t keep him in the U.S. while awaiting trial, stating simply, “No.” He also conveyed that Abrego Garcia would be deported just like any other undocumented individual.

During the hearing, Sinis expressed persistent concerns about the overall process and insisted on the necessity of having at least one credible witness with direct knowledge of Abrego Garcia’s case to clarify the government’s stance.
