Man caught on video hitting federal officer with sub sandwich escapes indictment

Prosecutors have stated that a former Justice Department employee, Shawn Charles Dunn, 37, who claimed he threw a sandwich at a federal officer in Washington, D.C., has managed to avoid felony assault charges. According to someone familiar with the situation, Dunn was caught on video shouting at a Customs and Border Protection (CBP) agent on August 10 while near 14th Avenue and U Street.

Witnesses reported that Dunn yelled, “Why are you here? I don’t want you in my city!” while facing the agent, even calling the officer “fascists” at one point. Allegedly, he then threw a sub-style sandwich at one of the police officers and collided with him before fleeing the scene. The incident, which turned into a viral video, captured laughter among those present as federal agents pursued him.

Dunn was later arrested and subsequently fired from his position at the DOJ. The U.S. Attorney for D.C., Jeanine Pirro, had asked the judge to consider felony assault charges against Dunn. However, it appears that a grand jury opted not to proceed with the charges, as noted in reports.

Pirro, who has committed to addressing crime vigorously under President Trump’s anti-crime initiative, referred to the incident after it happened, remarking that while some may find it humorous, it was a serious matter warranting police attention.

The situation has arisen amid a broader crackdown on crime, which has led to over 1,000 arrests according to the White House. It remains uncertain if the prosecutor will pursue lesser charges against Dunn in the future.

Fox News Digital has reached out for further comments from the Department of Justice regarding the case.
