Prosecutors in Colorado are set to drop charges against Solomon Garrigan, a 33-year-old registered sex offender, due to his inability to stand trial. The 18th Judicial District Attorney’s Office, which handles cases in Arapahoe County, plans to dismiss the charges stemming from an incident in April 2024 at Black Forest Hills Elementary School. Garrigan was accused of attempting to lure an 11-year-old boy while other children witnessed the event.
Aurora Police previously confirmed Garrigan’s status as a registered sex offender linked to the Pueblo County Sheriff’s Office. After his arrest, assessments deemed him mentally incompetent for trial, leading prosecutors to conclude they were mandated to withdraw the charges under state law.
The District Attorney’s Office clarified, “If a defendant is found to be mentally unfit for trial and is committed to mental health care, we are legally required to dismiss the charges.” They also indicated that a formal complaint regarding the dismissal would be filed by the end of the month, although this process has not yet occurred.
Interestingly, footage captured during the incident shows Garrigan chasing the young boy, raising safety concerns in the community. One eyewitness, Dante White, commented on how alarming the situation was, stating, “It’s so scary to see—especially with the person’s image. If he approached me, I’d be, well, shocked. It felt like a dangerous temptation.”
As parents of students at the school expressed their concerns, they submitted a detailed letter asking for an independent review of the school’s security measures. Following this, the Cherry Creek School District launched an investigation, resulting in administrative changes, including the dismissal of the former principal, Amanda Replogle.
Replogle has since acknowledged shortcomings in handling the situation, referring to it as a clear misstep. She mentioned that there was confusion about the protocols in place post-incident, admitting, “I didn’t have all the details then as I do now.” The school district is implementing reforms, enhancing mental health support, security protocols, and providing safer indoor options for students during breaks.
The Cherry Creek School District has yet to respond to requests for further comments on the matter.
