Newark Mayor Files Lawsuit Against Lawyer Over Trespassing Charges

Newark’s Democratic Mayor, Las Baraka, has initiated legal action against Alina Haba, a lawyer from New Jersey, alleging “malicious prosecution.” This lawsuit was filed on Tuesday morning, following Baraka’s arrest on May 9th, which he claims violated his Fourth Amendment rights.

The lawsuit states, “Defendant Haba issued a statement and approved Mayor Baraka’s false arrest, despite clear evidence showing that he did not commit the minor crime of ‘rebellious trespassing.'” It further accuses Haba of acting politically in allowing the arrest without a proper legal basis.

In a twist, Haba reacted to the lawsuit with ridicule, instead of any emotional rebuttal. She tweeted, “My advice to the mayor – join me in prioritizing violent crime and public safety. It’s a much better use of your time for the citizens of New Jersey.”

Baraka was arrested at Delaney Hall Detention Facility while protesting the ICE center, with his trespassing charges being dismissed just ten days later. This incident drew criticism from U.S. Magistrate Judge Andre Espinosa, who expressed that the case’s rush led to “embarrassing accusations” and emphasized the need for thorough investigations before exercising power.

The lawsuit also mentions Ricky Patel, the DHS oversight agent involved in Baraka’s arrest. Haba claims Baraka ignored multiple warnings before being detained. However, Baraka contends that he was compliant and had intended to leave before being apprehended.

Notably, the lawsuit surfaced on the same day that early in-person voting commenced in New Jersey.
