Los Angeles District Attorney George Gascón Announced Prosecutors announced Thursday that they will not file charges against a college student who allegedly stabbed a homeless man to death after catching him trying to break into his car.
Police arrested University of Southern California student Ivan Gallegos, 19, who admitted to stabbing a homeless man he witnessed breaking into several cars near campus on Monday when he confronted him. Gallegos said the man warned him he had a gun during the fight, but no weapon was found at the scene.
“We believe that Mr. Gallegos’ actions were born out of genuine fear for his own life and the life of others.”
The controversial Soros-backed district attorney, who has been criticized for being lenient in punishment for crimes, said Thursday that Gallegos would not be charged in the case.
“After careful consideration and a thorough review of all available evidence, we have decided not to file charges against USC student Ivan Gallegos,” the statement said. “We believe Mr. Gallegos’ actions were motivated by genuine fear for his own life and the life of others. Our hearts go out to the family and friends of the person who died and all those affected by this tragic incident.”
Gallegos was scheduled to be arraigned Thursday but was instead released.
The teen was walking down the street with two other students when they saw a man, later identified as 27-year-old Xavier Self, trying to break into a car. When they confronted him, an argument ensued, during which Gallegos stabbed the man.
“The USC community could have had three dead USC students.”
Gallegos’ friend, Rafael Cardenas, said Cerf made a gesture indicating he had a gun.
“We could have had three USC students die in the USC community. That would have been very unfortunate and tragic,” Cardenas said.
Surf’s Mother talked She told the Los Angeles Times that her son had a mental illness but was of a calm disposition.
“They’re making my son out to be someone he wasn’t,” said Yemma Jones. “He was a very active kid, he loved to dance. He wasn’t a violent kid.”
The case has drawn attention from people outraged by crime in Los Angeles and other big cities. Crime victims have slammed Gascón, who they accuse of giving criminals a free rein by not fully prosecuting them and getting them off the streets.
