The state's attorney general also argued that Allstate has not developed any reasonable safeguards to protect drivers' personal information.
On Monday, New York Attorney General Leticia James formally filed the case in court.
She argued that poor data security in the National General led to violations in 2020 and 2021. Meanwhile, hackers reportedly targeted online car insurance citing tools and accessed license numbers for more than 165,000 New Yorkers.
The national general is accused of failing to notify affected customers and New York agencies of the first violation that occurred between August and November 2020. It is also said that it took three months to reveal the second violation in January 2021.
James alleged that the state general violated the state's suspension hacking and improved electronic data security laws after failing to protect customer information. She accused the company of violating state consumer protection laws by misleading customers about its data security practices.
The lawsuit seeks a civil fine of $5,000 for each violation.
In January 2021, Allstate purchased the National General for around $4 billion.
In addition, in January, Texas Republican Attorney General Kenpaxton announcement Texas “was suing Allstate and its subsidiary Arity, for illegally collecting, using and selling data on the location and movement of Texans phones via software secretly built into mobile apps. Texans is worth better and we hold all these companies accountable.”
