Supreme Court Justice Samuel Alito has sent letters to representatives and senators in response to concerns about an upside-down American flag flying outside his Virginia home and an “Appeal to Heaven” flag flying at his vacation home in New Jersey.
In his letter, Alito said he would not recuse himself from former President Trump’s immunity lawsuit or other cases related to the 2020 presidential election or the Jan. 6 Capitol protests.
Senate Judiciary Committee Chairman Dick Durbin (D-Ill.) was among those who called on Justice Alito to recuse himself from these cases after it was revealed that an upside-down flag was flying in his Virginia home a week after the January 6, 2021, attack on the Capitol.
“Displaying an upside-down American flag, a symbol of the so-called ‘Stop the Steal’ movement, clearly conveys the appearance of bigotry,” Durbin said in a statement.

“Justice Alito should immediately recuse himself from cases related to the 2020 election and the January 6th insurrection, including the issue of former president’s immunity in United States v. Donald Trump, a case currently before the Supreme Court,” he added.
But in a message to Durbin and other senators on Wednesday, Alito wrote that the two incidents “do not meet the criteria for resignation.”
