Parents Sue After Son’s Death in Park Incident

The devastated parents of a 3-year-old boy who lost his life due to a monument collapse at a Washington state park are taking legal action.

On April 1, young Caleb Ortega was enjoying a day at Luke’s Park in Walla Walla with his father and sister when a large monument fell on him, leading to fatal injuries, according to reports.

Claudia Garcia, Caleb’s mother and a nurse, experienced severe emotional distress when her son was brought to the hospital via ambulance, as stated in the lawsuit.

Claudia and her husband, Miguel Ortega, are suing multiple companies for damages related to emotional suffering and distress.

In the meantime, the family has raised over $59,000 on a crowdfunding platform after receiving significant support from the community.

Describing the tragedy, the fundraising page highlights, “What began as a typical, joyful day of play ended in an unimaginable accident that took Caleb from us too early. None of us could foresee the heart-wrenching days that would follow. Though we are heartbroken, we cherish the wonderful memories he left us, like precious gifts.”

In an update from April 18, the page thanked supporters for their “overwhelming love, prayers, and support during this incredibly challenging time.”

The lawsuit, filed on May 12, includes Boulder Designs, Boulder Magic, Builders First Source, American Rock Products, Wenzel Nursery, Neil Binder and the Binder Family Community, as well as Double T Construction.

As of now, there’s been no response from these companies regarding the lawsuit. They have also not disclosed the amount of compensation being sought.

The memorial dedicated to Col. Albert H. Rooks/USS Houston CA-30 was renovated in 2019 as part of an Eagle Scout project. However, the lawsuit claims it was heavy, unstable, and lacked adequate warnings about potential hazards.
