Department of Education Revokes Access for Illegal Immigrants

The Department of Education announced on Thursday that it has overturned rules from the Clinton era that permitted illegal immigrants to access taxpayer funds for technical and career schools.

According to the Trump administration, these previously established rules violated the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA), which typically restricts such funding in programs related to career, technology, and adult education. The agency informed post-secondary educational institutions that the prior interpretations are no longer in effect, emphasizing that providers must now verify the eligibility of their participants.

Education Secretary Linda McMahon remarked, “Federal-funded postsecondary education programs should benefit American citizens, not illegal immigrants. Under President Trump’s leadership, taxpayers will not fund programs for those here illegally. We are ensuring that resources are reserved for citizens and legal immigrants who meet federal eligibility standards.”

Earlier this year, the Trump administration issued a Presidential Order aimed at ending taxpayer support for illegal immigrants, further tightening restrictions on federal funds.

PRWORA essentially limits federal public benefits to American citizens and lawful permanent residents. However, a provision from the Clinton administration in 1997 had previously exempted certain post-secondary programs like technical education from these restrictions. Now, Trump’s Education Bureau asserts that this exemption misrepresented the law, creating unnecessary distinctions regarding federal benefits based on how assistance is provided.

The Department of Education plans to implement these new interpretations starting August 9, 2025.

Recently, the Trump administration has actively opposed states that offer special educational benefits to illegal immigrants, even taking legal action against those allowing in-state tuition for undocumented individuals. In some cases, schools continue to advocate for illegal immigrants, seeking to protect them from deportation.

In a related announcement on June 30th, the government indicated that it was withholding nearly $7 billion in federal grants, which had previously funded programs like English as a second language. The administration criticized these funds, claiming they were used to advance a “radical left agenda,” often tied to illegal immigration.
