Trump’s Justice Department Withdraws Appeal Over ATF Ruling

On Thursday, the Justice Department under President Donald Trump decided not to pursue its appeal against a court ruling that determined the ATF overstepped its authority. This ruling was linked to an initiative aimed at implementing almost universal background checks for gun buyers in the U.S.

Gun owners voiced concerns, stating, “Under this rule, even a single private sale of a firearm could suddenly become a federal crime, with the ATF flipping the usual legal process and presuming gun owners guilty until they prove otherwise.”

In summer 2024, U.S. District Judge Matthew Kaksmarik ruled against this “engaged in business” regulation. The Law began to apply to residents of Texas, Louisiana, Mississippi, Utah, as well as members of various gun advocacy groups nationwide.

While the Biden administration initially appealed this ruling, the Trump administration ultimately chose to drop that appeal, suggesting that a reevaluation of the regulation was forthcoming.

Deputy Attorney General Stanley E. Woodward remarked on the appeal’s dismissal, stating that the Department of Justice is dedicated to reversing what it sees as oppressive Biden-era policies, which they feel infringe upon the Second Amendment rights of Americans.

Advocates for gun rights are optimistic that this decisive action regarding the Second Amendment signals significant changes ahead for the future leadership of the Justice Department under Pam Bondi.
