Authorities report that an undocumented immigrant, who allegedly exhibited signs of intoxication and could barely stand, is facing charges after driving off the road and fatally striking two children who were riding their bicycles on the sidewalk.
Eli Otoniel Robrero-Perez was denied bail on Monday and faces two felony counts of DUI causing death, alongside charges for driving without a license and having an open container. He is currently being detained at the Spartanburg County Detention Center.
The tragic incident took place around 12:20 p.m. on Sunday along Asheville Highway at Brock Street, which is situated roughly three miles west of Spartanburg.
According to the South Carolina Highway Patrol, Robrero-Perez was operating a 2016 Honda Accord eastbound when he veered off the roadway, hitting the two boys riding their bicycles on the sidewalk.
The boys who lost their lives have been identified as 12-year-old Deleon James Robbins and 9-year-old Michael Lee Smith, both residing in Spartanburg.
Both children succumbed to their injuries shortly after the incident.
During Monday’s bond hearing, emotional testimony revealed the defendant’s condition at the scene, which was reported by local media. There was a strong indication of intoxication, as Robrero-Perez displayed slurred speech, bloodshot eyes, and the unmistakable smell of alcohol, making it difficult for him to pass sobriety tests.
DeLeon’s mother recounted the harrowing moment she witnessed the car speeding towards her children. “I saw him almost hit me and I ran to my son while he bled to death,” she recounted.
The family has implored the judge to keep Robrero-Perez in jail. One of DeLeon’s brothers expressed deep sorrow, stating, “Now I have to bury my brother on my birthday.”
It was confirmed that another passenger was in the vehicle during the incident but managed to flee and has not been located.
Robrero-Perez is currently in the U.S. illegally, as confirmed by the Spartanburg County Sheriff’s Office, which noted that an immigration officer was assigned to his case.
The incident has ignited outrage in the community, prompting concerns about the circumstances surrounding the crash and a call for accountability. Senator Tim Scott expressed condolences, remarking on the heavy hearts for the families affected and hoping for swift justice.
Friends and family remembered DeLeon fondly, sharing that he was just days away from his 13th birthday and was known for bringing joy to those around him.
The family is advocating for responsible behavior, urging individuals to refrain from drinking and driving. “If you’re going to drink, stay home. Don’t drive. It’s not fun. It’s not cool,” a family member stated.
Robrero-Perez is set to return to court on June 18, with the investigation continuing.
