Virginia Prosecutor Criticized for Dropping Charges Against Illegal Alien
A prosecutor in Virginia, affiliated with the Democratic Party, is under fire for making a procedural error that led to an illegal alien escaping charges.
Naim Arrak faced potential prison time of up to 40 years and a hefty fine of $500,000 until Steve Descano, the Commonwealth’s Attorney for Fairfax County, mishandled a key aspect of the case.
According to reports, Descano seemed to have overlooked a crucial deadline established by the judge concerning witness exclusions. This oversight means that all charges against Arrak will need to be dismissed.
This isn’t the first incident of this nature. Sean Kennedy, a representative from Virginians for Safe Communities, pointed out a past case where inefficiencies from this same office allowed a man who had been charged with sexually assaulting an 11-year-old boy to be released with much lighter charges. Just months after his release, that individual allegedly abducted a woman in Prince William County.
“These injustices aren’t just abstract concepts; they result in real victims being denied justice,” Kennedy stated, adding that it allows dangerous individuals to return to the community.
Arrak’s legal troubles stemmed from an incident in 2025, where he evaded police and crashed into a fire hydrant. He has a lengthy criminal history, having been arrested over 30 times with more than 90 felony and misdemeanor charges spanning five counties. His past charges include serious offenses such as abduction and assault.
More recently, Arrak was charged with unlawfully possessing a firearm due to his immigration status. Despite some charges being dropped, he is still slated to go to trial in January 2027 and is currently in custody.
Descano has attracted criticism for his lenient approach to criminal justice, which some argue has led to the release of potentially dangerous individuals back into society.
