New York City has initiated a lawsuit against the Trump administration regarding its decision to revoke $47 million in federal funding tied to transgender policies in the city’s public schools.
The lawsuit, filed in federal court on Thursday, contends that the U.S. Department of Education cannot withdraw funding that was previously guaranteed. This action is based on a misinterpretation of civil rights law, according to the city’s arguments.
Education officials from the federal level stated last month that restroom policies in city schools supporting transgender students violate Title IX, which prohibits sex discrimination. They warned that New York City could face significant funding losses for its magnet schools if these policies are not reassessed.
However, the complaint asserts that federal authorities, including those from the previous Trump administration, have consistently ensured that the city’s Department of Education abides by sex discrimination laws.
The city’s argument suggests that the recent actions by federal officials are a “blatant attempt” to bypass due process in decisions impacting approximately 7,700 students enrolled in these schools.
Additionally, the city emphasized that any alterations to existing policies would contravene state and local laws mandating that students be allowed to use restrooms consistent with their gender identity.
“The department’s abrupt shift in policy seems rooted in a desire to overturn the previously accepted interpretation of Title IX by the Trump administration, prioritizing political motives over the needs of public schools,” the complaint indicates.
This lawsuit, which is being heard in Brooklyn federal court, seeks to halt any funding reductions while the legal proceedings are ongoing.
Superintendent Melissa Aviles-Ramos described the lawsuit as a necessary response to what she termed as attacks on magnet programs and on transgender and gender-expansive students by the Department of Education.
Muriel Good Trufant, the city’s chief legal officer, commented that Trump administration officials are “illegally trying to compel New York City public schools to alter their policies.”
Interestingly, Mayor Eric Adams has been notably absent from discussions surrounding the lawsuit. Although he’s publicly noted his skepticism regarding these bathroom policies, stating a preference against boys sharing bathrooms with girls, he remains out of the limelight on this issue.
Adams has expressed a lack of understanding as to why a high school boy would shower in a space with young girls, adding to the mixed responses surrounding this issue.
A spokesperson from City Hall remarked that “Mayor Adams will always fight for the city’s 1 million public school students,” without delving further into the lawsuit specifics.
Despite the absence of direct citations in the announcement about the lawsuit, Adams has made subsequent social media posts supporting the initiative, stating that the federal government is demanding actions that violate local and state law.
