Education Department Launches 18 Investigations Into School Policies for Transgender Students

U.S. Department of Education Launches Investigations into Gender Identity Policies

The U.S. Department of Education announced on Wednesday that it has initiated eighteen investigations into various K-12 school districts, higher education institutions, and state education departments regarding alleged violations of policies related to “gender identity.”

These investigations stem from complaints submitted to the Office for Civil Rights (OCR), claiming that these organizations have breached Title IX. This law forbids sex discrimination as a prerequisite for receiving federal funding for educational programs and activities.

The complaints accuse multiple educational entities of fostering sex discrimination by enabling students to engage in sports based on their “gender identity” instead of their biological sex.

The Department of Education expressed that this policy could “jeopardize both the safety and equal opportunity of women in educational programs and activities.” This concern is particularly highlighted by allowing individuals who identify as women to compete in women’s sports teams. The timing of the investigation coincided with the Supreme Court’s hearings on two critical cases regarding state laws that prevent men, including transgender men, from participating in women’s sports.

Assistant Secretary for Civil Rights Kimberly Ritchie stated, “In the same week that the Supreme Court hears oral arguments on the future of Title IX, OCR is actively pursuing allegations of discrimination against women and girls by organizations that allegedly allow men to participate in women’s sports.” She emphasized that the previous administration had repeatedly made it clear that violations of women’s rights, dignity, and equity are unacceptable.

  • Santa Rosa Junior College (California)
  • Waterbury Public Schools (Connecticut)
  • Hawaii Department of Education (HI)
  • Community School Unit 19 (ME)
  • Community School Unit 57 (ME)
  • Foxboro Public Schools (MA)
  • University of Nevada – Reno (NV)
  • Belmore-Merrick Central High School District (New York)
  • New York City Department of Education (NY)
  • Great Valley School District (PA)
  • Champlain Valley School District (Vermont)
  • Cheney Public Schools (Washington State)
  • Sultan School District No. 311 (Washington State)
  • Tacoma Public Schools (Washington State)
  • Vancouver Public Schools (Washington State)

Ritchie concluded, “We will do everything in our power to protect women’s right to equal access to educational programs in these investigations. This fight began more than half a century ago and is far from over.”
