Authorities in Southern California reported that a driver was killed during a police chase involving an illegal immigrant from Colombia last month.
Darwin Felipe Bahamon Martinez, 21, was arrested earlier in 2023 after entering the U.S. near San Diego but was released by the Biden administration. According to U.S. Immigration and Customs Enforcement (ICE), he crossed into the U.S. illegally in August 2023 near Chula Vista. ICE officials remarked that if not for the ‘catch-and-release’ policy, the 59-year-old victim he allegedly killed might still be alive.
On January 21, authorities said Martinez was driving a Jeep Gladiator when an officer stopped him for reckless driving. Instead of pulling over, he fled. Eventually, his vehicle collided with a Honda driven by a 59-year-old man from Placentia, who died at the scene. Another driver, an 83-year-old woman, sustained minor injuries and was taken to the hospital.
Martinez is currently in custody at the Orange County Jail, facing murder charges. An ICE match against him was registered shortly after the incidents occurred.
California’s sanctuary laws, however, do not mandate local officials to cooperate with ICE regarding the detention of undocumented immigrants who have criminal charges or convictions. ICE expressed concern, warning that releasing Martinez could pose a risk to the community.
In areas governed by sanctuary laws, ICE typically must conduct searches within communities for individuals marked for deportation. This has stirred debates, with some critics blaming sanctuary laws for allowing dangerous criminals to return to the streets.
