SCOTUS Rules States Cannot Disqualify Trump from 2024 Ballot

WASHINGTON, D.C. – Colorado cannot disqualify former President Donald Trump from appearing on the 2024 ballot, the U.S. Supreme Court ruled unanimously Monday.

In a historic ruling, the Supreme Court said only Congress can use the 14th Amendment’s “insurrection clause” to disqualify candidates from voting, and the same provision was used to disqualify former President Donald Trump from voting. The decision overturned a 4-3 Colorado Supreme Court opinion in December that held the ban. Regarding the 2024 presidential election ballot.

The ruling ruled that because Trump is not a U.S. official as defined by the 14th Amendment to the U.S. Constitution, the 14th Amendment cannot be used to disqualify him from participating in the Colorado primary election. It was a partial overturn of the Moon’s ruling.

This is the first time the U.S. Supreme Court has decided on Section 3 of the Fourteenth Amendment.
