Federal court rules Biden administration can’t force Christian businesses to pay for employees’ sex changes

Traynor wrote that HHS’s interpretation of Section 1557 of the ACA and the EEOC’s interpretation of Title VII prohibit Christian businesses from “proceeding to reassign sex in violation of a sincerely held religion.” It was approved to require “insurance coverage.”beliefs that do not meet rigorous scrutiny based on [Religious Freedom Restoration Act].

He also found that the Biden administration has failed to demonstrate that it cannot protect the rights of cross-dressers without infringing on the religious freedom of Christian employers.

Accordingly, Mr. Traynor issued a permanent injunction against both agencies, prohibiting them from imposing their respective interpretations on the CEA by requiring complainants to undergo gender reassignment procedures or pay costs.
