The Vulnerable Children Protection Act was passed in 2023, banning treatments such as puberty blockers, hormone therapy and corrective surgery for minors. The law had been blocked by a lower court that said treatment could continue while the case was pending.
Supreme Court Justice Neil Gorsuch wrote that lower courts went further than necessary. The court’s three liberal justices dissented from the ruling.
Rather than ending the statewide ban, the majority’s ruling allowed treatment for the two transgender teenagers to continue.
According to the law, doctors who treat transgender people under the age of 18 can be sentenced to 10 years in prison.
LGBTQ+ activists like transgender journalist Erin Reid denounced the ruling.
“The Supreme Court’s incredibly devastating decision for transgender people. The Supreme Court allows Idaho’s gender-affirming care ban to go into effect for everyone but plaintiffs.” Reid answered on social media. “I’m not sugar-coating this. It’s devastating for transgender youth across the country.”
“There is no good reason for this. This is cruel, vindictive, and will cause unnecessary harm to transgender youth.” answered activist Charlotte Clymer;

One of the plaintiffs is a 16-year-old transgender girl on puberty blockers, and the other is a 17-year-old transgender girl on puberty blockers and hormone therapy. Although both claim that treatment has improved their mental health, some studies show that the harms of transgender treatment far outweigh the reported benefits.
Britain’s National Health Service has announced that it will reconsider its treatment of transgender people in light of the conclusions set out in a 388-page report.
The Supreme Court is scheduled to hear other appeals against similar transgender laws in Tennessee and Kentucky. Twenty-one states have passed regulations for transgender treatment of minors, which critics say are dangerous and unproven.
