Jordan Chiles had her medal stripped by a lawyer currently working for Romania

The lead arbitrator on the Court of Arbitration for Sport (CAS) panel that stripped Jordan Chiles of her bronze medal in the women’s floor exercise final and awarded it to a Romanian gymnast who was appealing the decision has ties to the Romanian government for more than a decade.

Dr. Hamid G. Garavi, a lawyer of French and Iranian nationalityhas a long history of serving as an arbitrator and council member in various international disputes. His record shows that he is undoubtedly qualified to lead a CAS panel, but there are serious doubts as to whether Mr. Garavi should have been on the panel, given his deep ties to the Romanian government.

At the end of the women’s floor competition, Chiles was awarded the bronze medal after the United States protested that her scoring on one element was incorrect. The judges agreed with the US team and corrected Chiles’ score, moving her up to third place and pushing Romania’s Ana Barbos off the podium. Romania protested to the CAS in the days that followed, arguing that Chiles’ coach, Cécile Canquetto-Landi, protested the score four seconds after the one-minute deadline for seeking a correction.

The CAS ruled in Romania’s favor, saying the score appeal came too late, and rejected a US motion to reconsider the decision. The U.S. team is taking a 47-second appeal in light of new video evidence showing RandyWell before the deadline, the CAS said it had no mechanism for reopening the arbitration.

The central figure in this decision was Mr Garavi, who first made contact with Romania in 2011. He was appointed by three plaintiffs in a lawsuit who were all US residents. The case typically takes years to reach a conclusion, but after it was concluded in 2015, Garavi was hired as Romania’s ICSID representative. In its most basic form, a lawyer currently employed by Romania has been approved to chair the CAS committee that will decide whether to strip Jordan Chiles of his bronze medal and give it to a Romanian athlete.

Arbitrators on the CAS panel must fill out a conflict of interest form before hearing a case, and it is unclear whether Garabi disclosed his current ties to the Romanian government. Serious questions are raised about whether Chile and the United States received a fair hearing. The hearing not only stripped Chile of its only individual medal, but also voided the first time in Olympic history that three black athletes shared the podium in a gymnastics final.

The International Institute for Conflict Prevention and Resolution is an independent, non-profit organization. Questions were raised about Garavi’s suitability to preside over the CAS in the case, given his Romanian connections..

“The question is whether an Olympic arbitrator who currently represents a country on the international stage can fairly adjudicate a case involving that country’s gymnasts. Against Is it for the good of the country, or for the good of the gymnasts of that country, represented in this case by the Romanian Gymnastics Federation?”

The US has consistently questioned the legitimacy of international governing bodies when it comes to fairness and impartiality. Michael Phelps spoke to Congress ahead of the 2024 Paris Olympics. At this point, it is fair to give Mr. Garavi and the CAS the benefit of the doubt given his long history as an international judge, but at the same time, it raises the question of how an independent judicial system can function without bias when key decision-makers are allowed to be employed by parties they represent in other cases.
