Court Rules Biden Admin Wrong to Cut Texas Razor Wire on Border

The U.S. Court of Appeals for the Fifth Circuit ruled Wednesday that Texas can continue building wire-like border barriers. The court also ruled that the Biden administration was wrong to reduce barriers erected by the Texas National Guard under Gov. Greg Abbott's “Operation Lone Star.”

“A federal appeals court has ruled that the state of Texas has the right to build a razor wire border wall built to deny illegal entry into Texas,” Governor Abbott wrote on social media. Posted on. “Biden was wrong to cut our razor wire.”

The justices ruled that Texas was entitled to a preliminary injunction because it “seeks only to protect its property.” According to Reuters, the judges ruled that Texas was not trying to “regulate” the Border Patrol.

Circuit Judge Kyle Duncan, a Trump appointee, wrote in a 2-1 majority opinion that the public interest supports “clear protection of property rights from government intrusion and control.” He added that federal immigration enforcement “must not needlessly violate the rights of countless property owners.”

Former Texas Supreme Court Justice Don Willett, also appointed by President Trump, joined Duncan on the majority opinion.

Judge Irma Carrillo Ramirez, a Biden appointee, dissented, arguing that Texas had asserted “de facto review rights” over the federal government's immigration enforcement efforts.

In July, Breitbart Texas reported that Border Patrol agents cut border razor wire installed by the Texas National Guard on orders from Governor Abbott. FOX News reporter Bill Melzin released a video showing workers breaching the border wall.

DPS officials told Melgin that not only does the Texas Department of Public Safety have permission from the landowner to erect a barrier at the edge of the property, but the state also has permission to arrest immigrants who cross the barrier for trespassing. He said he was there.

The ruling in this case affirms the state's right to protect private property owners from illegal border crossers.
