Litigation
The Center for Justice Action, Human Rights First, and the Haitian Bridge Alliance sued on behalf of foreigners to prevent the Trump administration from ending the previous administration’s parole process. They found fellow activists in Talwani.
Judge Obama said, “The role of the agency in considering agency actions in this area is limited.” [DHS] The secretary’s discretion in this area is broad, but nevertheless she made it clear that she would interfere anyway.
Talwani said immigrants are in a position to challenge the shortened grant of parole, saying, “If parole status is allowed to expire, plaintiffs will face two disadvantageous options: continue the law, leaving the country on their own or awaiting removal procedures.”
The judge suggested that both options were undesirable.
Talwani pointed out that if they need to leave the United States, immigrants could face risk in their respective homelands by segregation of their families and seizing them of opportunities to obtain relief for administrative procedures law claims. If they remain illegally in the country, they will lose their permission to do legal work and likely face arrests, the judge wrote.
To save foreigners from election-backed reversals of democratic policy, Talwani ruled that he would temporarily maintain the legal status of CHNV immigrants and block the enforcement of the DHS on April 24th.
“Hundreds of thousands of our neighbors will fall asleep tonight tonight, knowing that for now, attempts to outlaw and criminalize our community are being thwarted.”
