Judge Boasberg Allowed Federal Surveillance of Conservatives — Now He Needs to Face Consequences

In early October, it emerged that the Biden administration had instructed the FBI to confiscate data from the cellphones of eight Republican senators and representatives as part of Jack Smith’s investigation into the 2020 election.

The past month has been filled with significant findings regarding this situation. Several individuals were implicated, including Republican Senator Ted Cruz from Texas and even former President Donald Trump, with organizations such as Charlie Kirk’s Turning Point USA getting involved as well.

Interestingly, the judge overseeing this case is District Judge James Boasberg, known for his controversial decisions. He ordered telephone companies not to inform those affected that their data had been seized, which raised quite a few eyebrows.

Frustrated Republicans, led by Rep. Brandon Gill of Texas, have initiated impeachment proceedings against Boasberg, claiming he compromised judicial fairness and misused his authority against political rivals.

Some critics question whether the impeachment will succeed, suggesting that it’s unlikely they could gather the necessary 67 Senate votes to oust him. While there’s some validity to that point, many argue that pursuing Boasberg’s impeachment remains essential.

First and foremost, Boasberg neglected to critically evaluate the government’s requests. The individuals involved were not ordinary criminals or attendees of the January 6 rally; they were elected officials and a former president whose records were targeted without any criminal allegations against them.

This raises another pressing concern: if such actions can happen to sitting senators, what does that mean for the average person? Senator Rick Scott from Florida has pointed out, “You can target a senator, but who can’t you?” It’s crucial to ensure accountability for those involved in this scheme, as they might target vulnerable individuals next. Senators generally have the means to attract media attention; ordinary individuals often don’t.

Boasberg’s approval of the seizure exemplifies his unfitness for the role. The government likely felt emboldened to request this data, knowing he would comply. It raises the question of whether there was any substantial proof that there was a risk of evidence being destroyed, particularly concerning influential senators. It seems implausible that figures like Senators Hawley, Cruz, and Johnson would even consider tampering with evidence. A clear message needs to be sent to judges across the spectrum that such negligence, or potential collaboration, is unacceptable.

Fortunately, there have been some steps taken, such as dismissals of certain agents involved. However, further actions are necessary. Jack Smith should be called to Congress to explain his conduct, and a thorough investigation is called for. Additionally, impeaching Judge Boasberg is a critical step that must be pursued.
